1. Acceptance of Terms

By accessing, browsing, or using the Flairo application, website, and related services (collectively, "the Service"), provided by Flairo ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. These Terms apply to all visitors, users, content creators, and others who access or use the Service.

If you do not agree to these Terms, you may not access or use the Service. Your continued use of the Service constitutes your agreement to be bound by these Terms and any future modifications.

2. Description of Service

Flairo is a platform that helps content creators track their video performance across social media platforms including TikTok, YouTube, and Instagram. We provide analytics, view tracking, and payout management services for creators participating in our programs.

3. Google API Services

Our Service uses Google API Services to access YouTube data. By using our Service and connecting your YouTube account, you also agree to be bound by Google's Privacy Policy and Google's Terms of Service.

Flairo's use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

You may revoke Flairo's access to your Google account at any time by visiting your Google Account permissions page.

4. Eligibility

You must be at least 13 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

5. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must notify us immediately of any unauthorized access to your account
  • You may not share your account with others or create multiple accounts

6. Creator Program Terms

Participation in our Creator Program is subject to approval. By participating, you agree to:

  • Original Content: Submit only original content that you own or have sufficient rights to monetize. Reposted, stolen, or copyright-infringing content is strictly prohibited.
  • Platform Compliance: Strictly adhere to the Terms of Service and Community Guidelines of all third-party platforms including TikTok, YouTube, and Instagram. A violation of their terms is a violation of these Terms.
  • No Manipulation: You shall not use bots, click-farms, fake accounts, or any automated means to artificially inflate views, likes, comments, or other engagement metrics ("View Botting").
  • Exclusive Submission: You agree not to submit the same video to multiple creator programs or monetization services unless explicitly permitted.

7. Payment and Payouts

Flairo pays eligible creators based on performance metrics ("Payouts").

  • Calculation: Payouts are calculated based on valid, verified unique views and engagement metrics as determined by our tracking systems. Our data is final and binding.
  • RPM and Thresholds: Earnings are based on a Rate Per Mille (RPM) and must meet minimum view thresholds (e.g., 10,000 views) to be eligible. Rates and thresholds are subject to change.
  • USA Audience Requirement: Payouts may be weighted or restricted based on audience geography (e.g., percentage of views from the USA).
  • Payment Schedule: Payouts are processed according to our payment schedule (e.g., Net-30 or weekly) after reaching the minimum withdrawal amount.
  • Fraud Prevention: We reserve the right to freeze or withhold payments indefinitely if we suspect fraud, view botting, copyright infringement, or breach of these Terms.
  • Taxes: You are solely responsible for reporting and paying all applicable taxes on income received from Flairo. We may require tax forms (e.g., W-9 or W-8BEN) before releasing payments.
  • Currency: All payments are made in US Dollars (USD) unless otherwise stated. You bear any currency conversion fees.

8. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Illegal Purpose: Using the Service for any illegal, unlawful, or unauthorized purpose.
  • System Manipulation: Attempting to reverse engineer, decompile, or hack the Service or bypass any security or authentication measures.
  • Scraping: Accessing or collecting data from the Service using automated means (bots, spiders, scrapers) without prior permission.
  • Interference: Interfering with or disrupting the integrity or performance of the Service or its related systems.
  • Harassment: Harassing, threatening, or defrauding other users or Flairo staff.
  • False Information: Providing false, misleading, or inaccurate information in your account or content submissions.

9. Indemnification

You agree to defend, indemnify, and hold harmless Flairo, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your content submissions, any use of the Service's content, services, and products other than as expressly authorized in these Terms.

10. Intellectual Property

The Service and its original content, features, and functionality are owned by Flairo and are protected by intellectual property laws. You retain ownership of content you create and submit, but grant us a license to use it in connection with the Service.

11. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, any pending payouts may be forfeited if termination was due to violation of these Terms.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLAIRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page. Your continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Flairo operates, without regard to its conflict of law provisions.
